Believe it or not, yes. I've seen people doing so on Ebay before. While it is less likely to happen with regular jersey, bat, pants, etc cards...you really have to watch yourself if it's a patch card.
Here;s a couple rules of thumb
If it's anything other than a basic slip of material it will say something like "Game worn patch," or "Game worn jersey prime" or something to that extent. If it has a large patch, and just says jersey, then stay away.
Also, be aware of the serial numbering. If the card is numbered out of 500 and has a beautiful patch, then it;s likely fake. Realize that there can only be a handful of patches to use, so anything over 50 should be taken cautiously. Take the advice from me...I have over 200 Game used cards.
